OFCCP: Affirmative Action Initiatives for 2010

The Office of Federal Contract Compliance Programs (OFCCP) has announced its regulatory agenda for next year. The following initiatives related to affirmative action are scheduled for analysis in 2010:

Affirmative Action — Rehabilitation Act

This Advance Notice of Proposed Rulemaking (ANPRM) would strengthen affirmative action requirements by requiring Federal contractors and subcontractors to conduct more substantive analyses and fully monitor their recruiting and placement efforts on behalf of individuals with disabilities. Target date: December 2010

Affirmative Action — VEVRAA

This Notice of Proposed Rulemaking (NPRM) would revise 41 CFR 60-250 and 60-300, implementing the nondiscrimination and affirmative action provisions of the Vietnam Era Veterans Act. The NPRM would require Federal contractors and subcontractors to conduct more substantive analyses of recruitment and placement actions taken under VEVRAA and would require the use of numerical targets to measure the effectiveness of affirmative action efforts. It would also make revisions to recordkeeping requirement. Target date: December 2010

The Director of the OFCCP stated that the agency will seek input from stakeholders on the type of statistical or other analyses that might be used by contractors to better monitor their employment practices with respect to applicants and employees with disabilities and protected veterans.

Construction Contractor Affirmative Action Requirements

The OFCCP's affirmative action regulations and goals applicable to construction contractors were last updated about thirty years ago. This NPRM would remove outdated regulatory provisions and update the provisions in the regulations that set forth the actions construction contractors are required to take to implement their affirmative action obligations. Target date: January 2011
